Includes a Sunset Harbour infrastructure review of the 1920 Alton Rd. application and a special meeting on the state law.

C7 AN 7–0Report due in 30 daysDiscussion Nov. 18
What passed. C7 AN directs staff to review documented sewer pump failures and water, sewer and stormwater capacity in Sunset Harbour, including for the 1920 Alton Road Live Local application. Staff must report within 30 days, with a discussion set for Nov. 18. The chair announced it approved 7–0 on a voice vote. [Resolution, C7 AN · 8:58:02 · 8:59:42]
Other items. C7 AP supports the mayor's outreach to other Florida mayors seeking changes to, or repeal of, the Live Local Act; it was approved by voice vote with no objection. C7 AQ, approved the same way, asks for a neighborhood-by-neighborhood capacity analysis. C7 AT asks for a report on hurricane evacuation and emergency services; the sponsor noted “only three exit routes,” and the chair announced it approved 7–0 on a voice vote. R7 AK, on outside legal counsel, was expanded to look at the state's Safe Structures and Resiliency Act and passed as amended. [C7 AP memo · 8:47:43 · 8:49:18 · 9:00:31 · 8:57:41]
Height benchmark. In a separate item, R7 AY, approved by voice vote, the city attorney will seek an outside legal opinion on whether the 519-foot height the Commission set for the Alton Gateway area by ordinance in 2018 counts as the Live Local height benchmark. The City Attorney's Office said its reading is that it does, cautioned that a contrary opinion could lead to litigation, and said the city cannot pause Live Local applications above 300 feet in the meantime. A related item, C7 AO, was withdrawn. [8:23:00 · 8:41:00 · 8:44:00 · 8:47:35]
What the public said. The morning citizens' forum ran about 51 minutes. Most speakers who addressed development asked the city to resist Live Local towers or questioned infrastructure capacity, and others raised flooding in Lakeview. A state representative said he is working on changes in Tallahassee. One speaker spoke in favor of the North Lincoln Lane project. Live Local applications were not on the agenda for a vote, so applicants for those projects did not speak. [0:16:37 · 0:40:16 · 0:53:08]
Special meeting. R9 AF and R9 AJ asked for a community meeting and a special Commission meeting on the Act. [R9 AJ memo · 9:07:13]
