The Commission voted 5–0 on first reading to close a gap that could have allowed taller buildings on Block 36 of the Crafts Section, the block between Le Jeune Road and Salcedo Street, north of the San Sebastian Apartments. Staff said the 2021 rezoning to MF-2 was meant to cap the block at 45 feet, but a drafting oversight left room for the Mediterranean architectural bonus.

Project facts. Malaga 300 LLC, owner of lots 10 through 15 at 300 Malaga Ave., received final Board of Architects approval on Aug. 13 for a four-story building with a partial fifth-level enclosed amenity deck. Its attorneys said the client has spent $3.7 million and asked for a vesting or 'savings' clause, citing a 2015 city attorney opinion that amendments don't apply to projects with final Board of Architects approval.

What was discussed. Commissioners said the 2021 intent was clear on the record and that nearby homeowners worry about being overlooked. The city manager said a carve-out for this property could let a different project return at up to 77 feet. Commissioners said the approved project can proceed if E 1 and the companion rooftop ordinance (E 2) both pass. One commissioner said they would not support E 1 without E 2. A resident argued an error is an error and the city shouldn't apply it selectively. No vesting clause was added. Second reading is next.
