MiMo Bay Apartments 2 Covenant Pushed to Next Meeting
Neighbors want the promised free public parking written into the resolution, and the right to enforce it.

The covenant for the MiMo Bay Apartments 2 project will wait two more weeks. At a commissioner's request, the Commission deferred items PZ 1 and PZ 2 to its next meeting without discussion.
What was said. During public comment, a neighborhood advocate thanked the city for adding three hours of free public parking to a revised covenant in the agenda backup, but said the resolution itself still doesn't include it. He also asked that neighbors be given legal standing to enforce the covenant, which, as drafted, is only between the city and the property owner. Another speaker urged closer oversight of large projects, citing dewatering and flood control on construction sites.
What's next. The items return at the next Commission meeting.
Earlier: Sept. 24 Meeting
The rezoning and covenant for MiMo Bay Apartments 2 on Northeast 64th Street were deferred after the Commission spent the afternoon on one question: what happens if the developer doesn't honor the public parking it promised. The second-reading ordinance would rezone 669 and 685 Northeast 64th Street and the east portion of 610 Northeast 64th Terrace.
What's in the covenant. As read on the record, the covenant provides 50 public parking spaces from 8 a.m. to midnight, no overnight parking, and free parking on Saturdays from 8 a.m. to 4 p.m. for the farmers market. A commissioner said the community benefit that was negotiated was three hours of free parking, seven days a week. A neighborhood advocate made the same point in public comment and asked that residents get legal standing to enforce it.
The enforcement debate. The city attorney said the charter can't grant residents standing under the covenant, citing case law, and pointed to the covenant's existing enforcement paragraph. A commissioner floated a $200,000 penalty per violation; the city attorney cautioned that because the covenant was voluntarily offered, the city has to avoid contract zoning. The applicant's attorney said they would take the proposals to the client.
What's next. After an attorney-client session, both items were deferred to the next meeting. At that Oct. 8 meeting, the items were deferred again.
